Terms of Service

1. Acceptance of Terms

By accessing and using the Extreme Sports Fishing Australia ("ESFA") platform, website, and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Eligibility

You must be at least 18 years of age to create an account and participate in competitions on ESFA. By registering, you represent and warrant that you meet this age requirement and that all information you provide is accurate and complete.

3. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use.

4. Competition Rules

Each fishing competition hosted on ESFA is subject to its own specific rules, which will be clearly outlined on the competition page. General rules include:

  • One entry per person per competition unless otherwise stated
  • All catches must be genuine and verifiable through our photo/AI verification system
  • Entries must be submitted within the competition timeframe
  • Tampering with photos, measurements, or catch data will result in immediate disqualification and potential account suspension
  • ESFA reserves the right to verify any entry and request additional evidence

5. Purchases and Tickets

Competition entry tickets and merchandise are purchased through our integrated shop powered by Shopify. All purchases are subject to Shopify's payment terms. Ticket prices are displayed in Australian Dollars (AUD) and include GST where applicable.

Competition tickets are non-transferable and non-refundable once a competition has commenced. Refunds for tickets to competitions that have not yet started may be requested within 48 hours of purchase.

6. Prize Distribution

Prizes are awarded as described on each competition page. ESFA reserves the right to substitute prizes of equal or greater value. Winners will be notified via the platform and email. Prizes must be claimed within 30 days of notification.

7. User Content

By posting content (photos, comments, catch reports) on ESFA, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content in connection with the platform. You retain ownership of your content and can delete it at any time.

You agree not to post content that is offensive, defamatory, infringes on intellectual property rights, or violates any applicable law.

8. AI Catch Analysis

ESFA uses artificial intelligence to analyse catch photos for species identification and measurement verification. While we strive for accuracy, AI analysis is provided as a guide and may not always be correct. Final verification decisions rest with ESFA administrators.

9. Prohibited Conduct

You agree not to:

  • Use the platform for any unlawful purpose
  • Submit fraudulent competition entries
  • Harass, abuse, or threaten other users
  • Attempt to gain unauthorised access to the platform or other users' accounts
  • Use automated tools, bots, or scrapers on the platform
  • Interfere with the platform's operation or security

10. Limitation of Liability

ESFA is provided "as is" without warranties of any kind. To the maximum extent permitted by Australian law, ESFA shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the platform after changes constitutes acceptance of the modified terms.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland.
